The three- and ten-year bars to admissibility of
section 212(a)(9)(B)(i) of the Act and the permanent bar to admissibility of
section 212(a)(9)(C)(i)(I) of the Act were added by the Illegal Immigration
Reform and Immigrant Responsibility Act of 1996.
Section 212(a)(9)(B)(i)(I) of the Act renders
inadmissible those aliens who were unlawfully present for more than 180 days
but less than one (I) year, who voluntarily departed the United States prior to
the initiation of removal proceedings and who seek admission within three (3) years
of the date of such departure or removal from the United States.
Section 212(a)(9)(B)(i)(II) of the Act renders
inadmissible those aliens unlawfully present for one (1) year or more, and who seek
admission within ten (10) years of the date of the alien's departure or removal
from the United States.
